Overview
Welcome to SnapFig. The terms “SnapFig,” “we,” “us” and “our” refer to the business operating this store and website. SnapFig provides this website, including all related information, content, features, tools, products and services, in order to offer you a personalized shopping experience (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in them (collectively, the “Terms”), describe your rights and responsibilities when you visit, access or use the Services, upload photographs or other content, or purchase products from us.
Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use the Services.
Section 1 – Eligibility and Accounts
To place an order through the Services, you must be at least the age of majority in your place of residence or otherwise have the involvement and authorization of a parent or legal guardian as permitted by applicable law.
You may be asked to provide information such as your name, email address, billing information, shipping information and payment details. You agree to provide information that is current, complete and accurate and to update it where reasonably necessary.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You must notify us promptly if you believe that your account has been accessed or used without authorization.
Section 2 – Our Products
SnapFig offers personalized products that may be created from photographs, selections and instructions submitted by customers. Because these products are individually designed and manufactured, each finished item may have characteristics unique to that order.
We make reasonable efforts to display product descriptions, dimensions, colors, previews and other information accurately. However, colors and appearance may vary depending on screen settings, lighting and device configuration. Minor differences in color, texture, proportions, surface finish or other handcrafted and 3D-printed details may occur between website images, digital previews and finished products.
These reasonable variations do not affect any rights or remedies that may be available for products that arrive damaged, defective, incorrect or materially different from the submitted order details or the visual preview associated with the order. Relevant remedies are described in our Refund Policy. Additional product coverage is described in our Warranty.
Product descriptions, options and availability may be updated from time to time. We may discontinue a product or limit the quantities available where reasonably necessary.
Section 3 – Customer-Submitted Photos and Content
The Services may allow you to submit photographs, customization instructions, messages and other materials in connection with a personalized order (collectively, “Order Content”).
You retain any rights you already hold in your original Order Content. By submitting Order Content, you grant SnapFig a limited, non-exclusive, worldwide and royalty-free license to access, reproduce, process, modify and share that Order Content only as reasonably necessary to:
- generate and display product previews.
- create, refine or adjust 3D models and designs.
- manufacture and perform quality checks on personalized products.
- fulfill, deliver and support your order.
- process permitted remakes, refunds, claims or other resolutions.
- operate and protect the Services as permitted by applicable law.
This license allows us to provide Order Content to service providers that assist with functions such as image processing, preview generation, 3D modeling, cloud storage, manufacturing, quality control and order fulfillment. Our handling of Order Content is also subject to our Privacy Policy.
We will not use Order Content in public product galleries, social media posts or promotional materials without appropriate permission.
By submitting Order Content, you confirm that:
- you own the content or have the rights, authority or permission reasonably necessary to submit and use it for the requested personalized product.
- where the content depicts another individual, you have appropriate permission to authorize its use for the requested product.
- where the content depicts a child, you are the child’s parent or legal guardian or otherwise have appropriate authority or permission.
- the content does not unlawfully infringe another person’s copyright, trademark, privacy, publicity, personality or other rights.
- the content does not violate these Terms or applicable law.
We may decline, suspend or cancel an order if we reasonably believe that submitted content is unlawful, infringing, fraudulent, abusive, threatening, hateful, sexually explicit or otherwise inappropriate for the Services. Where an order is cancelled for this reason, any refund will be handled in accordance with the circumstances and applicable law.
Section 4 – Photo Quality and Customization Information
You are responsible for reviewing the photographs, product options, spelling, messages, sizes, quantities and customization instructions submitted with your order.
Photographs should be clear, appropriately lit and suitable for the requested product. Details that are blurred, cropped, covered or not visible in the submitted photograph may not be reproduced accurately.
We may contact you to request additional information, a replacement photograph or clarification of your instructions. Production and delivery estimates may be affected if we do not receive the requested information within a reasonable time.
We may make reasonable technical or artistic adjustments that are necessary to create a workable 3D model or finished product, provided those adjustments do not materially change the principal characteristics shown in the selected style, customization options or confirmed order details.
Section 5 – Visual Previews and Production Modeling
Before placing an order, customers may be able to generate a visual preview through the Services. The preview is intended to help illustrate the selected style and general appearance of the personalized product.
A visual preview is a reference rather than an exact representation of every detail of the production-ready 3D model or completed physical product. Customers should review their photographs, selected options and customization information carefully before placing an order.
After an order is placed, we may review the submitted materials and prepare or refine the model used for production. If additional photographs, information, adjustments or confirmation are reasonably needed, we may contact you before production proceeds. Not every order will necessarily require an additional confirmation stage.
Requests made after personalized modeling, production preparation or production has started may not be possible and may result in additional costs or delays. Digital previews may not reflect the exact color, surface texture, scale or finish of the completed physical product. Reasonable differences associated with screen display, production modeling, hand-finishing and 3D-printing processes may occur.
Section 6 – Orders and Acceptance
When you place an order, you are making an offer to purchase the selected products subject to these Terms. Receipt of an order confirmation does not prevent us from contacting you if additional photographs, information or verification are reasonably required.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, unauthorized payment, product unavailability, material pricing or description errors, prohibited Order Content, or inability to complete the requested customization.
If we decline or cancel an order after payment has been received, we will notify you using the contact information provided with the order and issue any refund required under the circumstances and applicable law.
Personalized products may enter the design or production process shortly after an order is placed. Changes and cancellations therefore depend on the stage reached when the request is received. Please review your order carefully before submitting it and contact us as soon as possible if you need to request a change or cancellation.
Cancellation, return, exchange and refund requests are subject to our Refund Policy.
Section 7 – Prices, Payment and Taxes
Prices, discounts and promotions may change from time to time. The price charged for an order will be displayed before checkout and reflected in the applicable order confirmation.
Unless expressly stated otherwise, displayed product prices may not include applicable taxes, optional expedited delivery charges, customs duties, import taxes or other charges imposed by governmental or customs authorities. Charges payable directly to SnapFig will be disclosed during checkout where reasonably practicable.
International customers may be responsible for customs duties, import taxes, value-added tax or other charges imposed by the destination country. Additional information is available in our Shipping Policy.
You agree to provide accurate and authorized payment information. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize the applicable payment provider to charge the amount shown during checkout.
Payments may be processed by Shopify or other payment service providers. Their processing of payment information may also be governed by their own terms and privacy policies.
Section 8 – Shipping and Delivery
Production, processing, shipping and delivery times are estimates unless expressly stated otherwise. Personalized products may require order review, production modeling, additional information or confirmation where needed, production and quality inspection before shipment.
Delivery estimates may be affected by the quality of submitted materials, customer response times, requested changes, production requirements, carrier operations, customs processing, destination restrictions, severe weather, peak seasons and other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate shipping address. If you identify an error, please contact us as soon as possible. We may be unable to change an address after production or shipment has begun.
Shipping methods, estimated timeframes, costs, tracking, customs charges and the handling of delayed, damaged, lost or undelivered packages are described in our Shipping Policy.
Section 9 – Returns, Refunds and Warranty
Because SnapFig products are personalized and created from customer-provided photographs and instructions, they may not be eligible for returns, exchanges or cancellations based solely on a change of mind after design or production has begun.
This does not limit remedies that may be available for products that arrive damaged, defective, incorrect, are confirmed lost in transit, or are materially different from the submitted order details or the visual preview associated with the order.
Eligibility requirements, request procedures, evidence requirements, processing timeframes and possible resolutions are described in our Refund Policy. Additional product coverage is described in our Warranty.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty, right or remedy that cannot lawfully be excluded, restricted or modified under applicable law.
Section 10 – Intellectual Property
Except for Customer Order Content and content owned by third parties, the Services and their content—including the SnapFig name and branding, website design, text, graphics, illustrations, product materials, videos, audio, software and arrangement—are owned by or licensed to SnapFig and are protected by applicable intellectual property laws.
Subject to these Terms, you may access and use the Services for personal, lawful and non-commercial purposes. You may not reproduce, distribute, modify, publicly display, publish, sell, license, extract or commercially exploit protected materials from the Services without the permission of the applicable rights holder.
Purchasing a physical product does not automatically transfer ownership of internal production files, editable 3D models, design systems, manufacturing methods, software or other materials used to create that product, except where expressly agreed in writing.
Shopify’s names, logos, products and services are trademarks of Shopify. Other names, logos and trademarks appearing through the Services remain the property of their respective owners.
Section 11 – Feedback and Reviews
If you voluntarily submit a review, idea, suggestion or other feedback concerning the Services (“Feedback”), you grant SnapFig a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish and display that Feedback for purposes such as operating, improving and promoting the Services, subject to applicable law.
For clarity, Feedback does not include photographs, likenesses, customization instructions or other content submitted solely for the creation and fulfillment of a personalized order. Such content is treated as Order Content under Section 3.
If you include a photograph or another person’s personal information in a public review, you should ensure that you have the appropriate rights or permission to do so.
Feedback must be truthful and must not be unlawful, misleading, abusive, obscene, defamatory, infringing or otherwise violate another person’s rights. We may moderate or remove Feedback where reasonably necessary, although we are not obligated to monitor all submissions.
Section 12 – Optional Tools and Third-Party Services
We may provide access to tools, features or services operated by third parties. We may not control or monitor all aspects of those third-party services.
Your use of a third-party service may be subject to the third party’s own terms and privacy policies. To the extent permitted by law, SnapFig is not responsible for third-party services that are not operated or controlled by us.
We may introduce new features, tools or resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.
Section 13 – Third-Party Links
The Services may contain links to websites or platforms operated by third parties. We are not responsible for evaluating or guaranteeing the accuracy, availability, privacy, security or content of third-party websites.
If you access or purchase from a third-party website, you do so subject to that third party’s applicable terms and policies. Concerns regarding a third-party product or service should generally be directed to the relevant third party.
Section 14 – Relationship with Shopify
SnapFig is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are made directly between you and SnapFig.
To the extent permitted by applicable law, Shopify is not responsible for the products sold by SnapFig or for claims arising solely from a purchase made between you and SnapFig.
Section 15 – Privacy
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information concerning your access to and use of the Services. Additional information is available in the Shopify Consumer Privacy Policy .
Section 16 – Prohibited Uses
You may not use the Services or submit content:
- for an unlawful, fraudulent, abusive or malicious purpose.
- in violation of applicable laws or regulations.
- to infringe intellectual property, privacy, publicity, personality or other rights belonging to another person.
- to harass, threaten, impersonate, defame, exploit or harm another person.
- to submit false, deceptive or materially misleading information.
- to transmit malicious code or interfere with the security, integrity or operation of the Services.
- to collect or track another person’s personal information without appropriate authority.
- to send spam, unauthorized advertising or other unsolicited communications.
- to bypass security measures, access restrictions, robot exclusion controls or other technical limitations.
- to reproduce, scrape, extract, resell or commercially exploit a substantial portion of the Services without authorization.
We may restrict or suspend access to the Services where we reasonably believe these Terms have been violated or where action is necessary to protect SnapFig, our customers, service providers or others.
Section 17 – Errors, Availability and Corrections
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, customization options, prices, promotions, shipping charges, delivery estimates or availability.
We may correct errors and update information where reasonably necessary. If a material error affects an order you have already submitted, we may contact you to confirm the corrected information or cancel the affected order and provide an appropriate refund.
Section 18 – Termination
We may suspend or terminate your access to some or all of the Services if you materially violate these Terms, use the Services unlawfully, create a security risk or fail to pay amounts properly due.
Termination does not remove payment or other obligations that arose before termination. Provisions that by their nature should continue—including provisions concerning intellectual property, submitted content, disclaimers, liability, indemnification and dispute resolution—will survive termination.
Section 19 – Disclaimer of Warranties
Except for warranties expressly provided by SnapFig or rights that cannot lawfully be excluded, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free or available at all times.
To the fullest extent permitted by applicable law, we disclaim implied warranties that may otherwise apply to the Services. This disclaimer does not override our Warranty, our Refund Policy, or any mandatory consumer rights.
Section 20 – Limitation of Liability
To the fullest extent permitted by applicable law, SnapFig and its directors, officers, employees, contractors, agents and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Services or products purchased through the Services.
Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection law.
Where liability may lawfully be limited, SnapFig’s aggregate liability arising from a particular order will generally not exceed the amount you paid to SnapFig for that order, except where a different remedy is required by applicable law.
Section 21 – Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold SnapFig harmless from third-party claims, liabilities, damages and reasonable costs arising from:
- your material breach of these Terms.
- your unlawful use of the Services.
- Order Content you submit without necessary rights or permission.
- your violation of another person’s rights or applicable law.
We will provide reasonable notice of an indemnifiable claim and may control its defense and settlement, subject to applicable law. You agree to provide reasonable cooperation in responding to the claim.
Section 22 – Severability, Waiver and Entire Agreement
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will remain in effect.
A failure or delay by SnapFig to enforce a provision of these Terms does not waive our right to enforce it later.
These Terms and the policies incorporated by reference constitute the agreement between you and SnapFig regarding use of the Services and supersede prior communications concerning the same subject matter.
Section 23 – Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets or other business transaction, subject to applicable law.
Section 24 – Governing Law
These Terms and any separate agreements under which we provide the Services are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.
Any dispute that cannot be resolved informally may be submitted to the courts of competent jurisdiction in the Hong Kong Special Administrative Region, except where mandatory laws in your place of residence provide you with the right to bring a claim in another jurisdiction.
Nothing in this section limits mandatory consumer protection rights that may apply in your place of residence.
Section 25 – Changes to These Terms
We may update these Terms from time to time to reflect changes to the Services, our business practices, technology or applicable legal requirements.
The revised Terms will be posted on this page with an updated “Last updated” date. Where required by applicable law, we may provide additional notice of material changes.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.
